1. General Provisions

  1. 1.1) These Terms of Service govern the use of the service jpg-gen.com (hereinafter "Service").
  2. 1.2) The Service enables the generation of images through artificial intelligence (AI) based on text input.
  3. 1.3) The Service is exclusively intended for persons aged 18 and above.
  4. 1.4) Each AI model has its own content filters and age restrictions. These are displayed when selecting the model.
  5. 1.5) Users are required to observe the specific warnings and restrictions of each model.

2. Access and Usage

  1. 2.1) Access to the Service is exclusively through Google OAuth 2.0.
  2. 2.2) Users may commission image generations using credits purchased through the Service.
  3. 2.3) Users may only commission one image generation at any given time.
  4. 2.4) The Service implements rate limits for fraud and abuse prevention to ensure service availability.
  5. 2.5) There are no daily or monthly generation limits beyond the rate limits mentioned above.

3. Credits and Payments

  1. 3.1) Nature of Credits:
  2. 3.1.1) Credits are a virtual currency used exclusively within the Service to commission image generations.
  3. 3.1.2) Credits are not real currency and have no monetary value outside the Service.
  4. 3.1.3) Credits cannot be exchanged for cash or any other form of payment.
  5. 3.1.4) By purchasing credits, users acknowledge they have no claims regarding the credits beyond their use within the Service.
  6. 3.2) Purchasing Credits:
  7. 3.2.1) Credits are purchased in bundles through our payment provider Stripe.
  8. 3.2.2) The minimum purchase is €4.99 (smallest bundle).
  9. 3.2.3) The maximum purchase is €24.99 (largest bundle).
  10. 3.2.4) Users may hold a maximum of 100,000 credits at any time. Further purchases are not possible until credits are spent.
  11. 3.2.5) Prices are displayed in multiple currencies and include VAT/taxes where applicable. Users are informed of the final price including taxes during checkout.
  12. 3.3) Credit Validity:
  13. 3.3.1) Credits do not expire under normal circumstances.
  14. 3.3.2) In the event the Service closes indefinitely, remaining credits will be refunded.
  15. 3.4) Non-Refundable Credits:
  16. 3.4.1) Credits are non-refundable once payment has been successfully processed.
  17. 3.4.2) Commissioned image generations are non-refundable. Once a generation is initiated, the credits used are consumed.
  18. 3.4.3) Exception: Credits will be automatically refunded in cases of technical failure where the generation could not be completed due to system errors.
  19. 3.5) Credit Pricing:
  20. 3.5.1) The credit cost of image generations may change at any time due to changes in compute costs, infrastructure costs, or global economic factors.
  21. 3.5.2) Changes to generation costs do not affect existing credits; only the cost per generation changes.
  22. 3.5.3) The Service aims to keep prices stable or decreasing, but cannot guarantee this.
  23. 3.5.4) The price of credit bundles remains stable and is only modified during promotional campaigns or special offers.
  24. 3.6) Promotional and Bonus Credits:
  25. 3.6.1) Bonus credits received through promotions are treated identically to purchased credits.
  26. 3.6.2) Bonus credits have the same terms and do not expire.
  27. 3.7) Chargebacks and Payment Disputes:
  28. 3.7.1) If a chargeback occurs, the corresponding credits will be deducted from the user's balance.
  29. 3.7.2) A user's credit balance may become negative as a result of chargebacks.
  30. 3.7.3) Negative balances must be settled before any new credits can be used for generations.
  31. 3.7.4) Only positive credit balances can be used for image generation requests.
  32. 3.7.5) Multiple chargebacks or suspected payment fraud may result in account suspension.
  33. 3.8) Credits are Non-Transferable:
  34. 3.8.1) Credits cannot be transferred between accounts.
  35. 3.8.2) Credits cannot be gifted to other users.

4. Copyright and Usage Rights

  1. 4.1) Images generated through the Service are subject to the license terms of the respective AI models.
  2. 4.2) Users must consult the license attached to each model to determine usage rights, including whether commercial use is permitted.
  3. 4.3) The specific license terms for each model are displayed during model selection.
  4. 4.4) The Service does not claim ownership of generated images; ownership and usage rights are determined by the respective model's license.
  5. 4.5) The Service reserves the right to restrict or prohibit the use of certain AI models.

5. Content Restrictions

  1. 5.1) The generation of the following content is strictly prohibited:
  2. 5.1.1) Pornographic or sexually explicit content of any kind
  3. 5.1.2) NSFW (Not Safe For Work) content or material
  4. 5.1.3) Adult-only content (18+) or mature content
  5. 5.1.4) Sexually suggestive or provocative imagery
  6. 5.1.5) Nudity or explicit anatomical depictions
  7. 5.1.6) Content that violates community standards regarding adult material
  8. 5.1.7) Depictions of violence or abuse
  9. 5.1.8) Depictions of minors
  10. 5.1.9) Images of real persons
  11. 5.1.10) Illegal or unlawful content
  12. 5.1.11) Content that violates applicable law
  13. 5.1.12) Content that violates the age restrictions of the respective AI models
  14. 5.2) The Service performs automatic content checks and reserves the right to reject requests.
  15. 5.3) Violations of these restrictions may result in immediate account suspension.
  16. 5.4) Examples of prohibited content:
  17. 5.4.1) Political or religious hate speech
  18. 5.4.2) Racist or discriminatory content
  19. 5.4.3) Depictions of criminal acts
  20. 5.4.4) Deepfakes or deceptively similar representations of real persons
  21. 5.5) Each AI model may have additional, specific content restrictions. These are displayed during model selection.
  22. 5.6) The Service reserves the right to block certain models for specific user groups or require additional age verification.

6. Abuse and Prohibited Activities

  1. 6.1) The following activities are strictly prohibited:
  2. 6.1.1) Generating prohibited content as defined in Section 5
  3. 6.1.2) Circumventing technical measures implemented to ensure compliance and service availability
  4. 6.1.3) API scraping or automated access to the Service
  5. 6.1.4) Reverse-engineering routes, endpoints, or any part of the Service
  6. 6.1.5) Attempting to exploit vulnerabilities in the Service
  7. 6.1.6) Creating multiple accounts to circumvent restrictions
  8. 6.2) Abuse may result in immediate account suspension without prior notice.

7. Service Availability

  1. 7.1) The Service does not guarantee uptime or availability.
  2. 7.2) The Service operates on a best-effort basis to provide high uptime and minimize downtime.
  3. 7.3) Users are not entitled to compensation for any downtime.
  4. 7.4) If downtime affects ongoing generations and results are lost, any credits involved will be refunded.

8. Disclaimer of Liability

  1. 8.1) The Service assumes no liability for:
  2. 8.1.1) The quality or suitability of generated images
  3. 8.1.2) Legal violations by users
  4. 8.1.3) Losses or damages resulting from the use of the Service
  5. 8.1.4) Service interruptions or downtime
  6. 8.2) The Service is operated to the best of our knowledge and belief, but cannot guarantee availability or functionality.

9. Data Protection

  1. 9.1) The processing of personal data is carried out in accordance with the Privacy Policy.
  2. 9.2) The Service does not store generated images permanently.
  3. 9.3) Users are responsible for the security of their access credentials.

10. Changes to Terms of Service

  1. 10.1) The Service reserves the right to modify these Terms of Service at any time.
  2. 10.2) Users will be informed of significant changes.
  3. 10.3) Continued use of the Service after changes constitutes acceptance of the modified terms.

11. Account Suspension

  1. 11.1) The Service reserves the right to suspend user accounts without prior notice in case of:
  2. 11.1.1) Violation of these Terms of Service
  3. 11.1.2) Suspicion of abuse
  4. 11.1.3) Technical manipulation of the Service
  5. 11.1.4) Multiple chargebacks or payment fraud
  6. 11.1.5) Generation of prohibited content
  7. 11.2) Suspended accounts forfeit all remaining credits immediately.
  8. 11.3) Suspended users may still log in to view their account status and balance, but cannot:
  9. 11.3.1) Commission new image generations
  10. 11.3.2) Purchase or modify their credit balance
  11. 11.3.3) Interact with the Service in any meaningful way
  12. 11.4) Suspended users will see a banner informing them of their suspension status.
  13. 11.5) Suspension may be temporary or permanent at the sole discretion of the Service.
  14. 11.6) Suspended users have no claim to refund of any credits, purchased or promotional.

12. Final Provisions

  1. 12.1) These Terms of Service are governed by German law.
  2. 12.2) If individual provisions are invalid, the validity of the remaining provisions shall not be affected.
  3. 12.3) The place of jurisdiction shall be the registered office of the Service, to the extent permitted by law.
